Florida Man Imprisoned to 10 years for 3.3 Million U.S. Dollars Cancer Genetic Testing Fraud Conspiracy.

 

On 14th April 2021, a man from Florida was sentenced to ten years in prison for a scheme to perpetrate health care fraud in association with a conspiracy that led to the submission of about 3.3 million U.S. dollars in deceitful claims to the Medicare program for genetic testing.

On 8th January 2021, a federal jury convicted Ivan Andre Scott, age 36, from Kissimmee, of one conspiracy charge to perpetrate health care fraud, three health care fraud counts, one conspiracy count to reimburse and obtain illicit health care kickbacks, and three charges of obtaining illicit kickbacks. As per the court affidavits, Ivan Scott owned Scott Global, an Orlando-based telemarketing call center. The attestation revealed that Ivan Scott targeted the Medicare program recipients with telemarketing phone calls deceitfully stating that the Medicare program covered costly cancer screening genetic testing or “CGx” tests. Every test costs approximately 6,000 U.S. dollars. Once Medicare beneficiaries consented to take the CGx test, the attestation revealed Ivan Scott reimbursed illicit kickbacks and bribes to telemedicine firms to acquire physician’s orders permitting the tests.

The attestation at trial revealed that the telemedicine physicians authorized the costly testing although they were not treating the recipients for symptoms of cancer or cancer and frequently without even meeting with the recipient. As per the attestation presented at trial, Ivan Scott later traded the genetic tests and physician’s orders to labs in return for illicit kickbacks. To cover up the illicit kickbacks, Ivan Scott submitted invoices to the labs and other promoters making it look like he was being reimbursed for hourly marketing services instead of per referral.

From November 2018 to May 2019, laboratories submitted over 3.3 million U.S. dollars in claims to the Medicare program for genetic screens that Ivan Scott had sent to them, of which the Medicare program reimbursed more than 1.3 million U.S. dollars. In that timeframe, Ivan Scott personally obtained about 194,000 U.S. dollars for his participation in the conspiracy.

The matter was probed by the FBI and HHS-OIG.
