A Pharmacist from Clinton Convicted to 120 Months Imprisonment for a Scheme to Commit Health Care Fraud

Jackson, Mississippi – Acting United States Attorney Darren J. LaMarca, Special Agent in Charge of the Federal Bureau of Investigation in Mississippi Michelle Sutphin, Special Agent in Charge of the Internal Revenue Service Criminal Investigation James Dorsey, Special Agent in Charge of the Defense Criminal Investigative Services Southeast Field Office Cynthia Bruce, and Director of the Mississippi Bureau of Narcotics Steven Maxwell announced on 2nd February 2021, that Marco Bisa Hawkins Moran, from Clinton, Mississippi, age 45, was convicted by the United States District Judge Keith Starrett to 10 years federal imprisonment followed by 3 years of release under supervision for a scheme to commit health care fraud.

Moran was also instructed to pay a monetary judgment amounting to 12,195,740 U.S. dollars, 22,096,697 U.S. dollars in restitution, and a fine of 20,000 U.S. dollars.

From 2014 to 2016, Moran, as one of the owners of Medworx Compounding and Custom Care Pharmacy, engaged in a conspiracy to defraud Tricare and other medical insurance programs, including those that covered employees of Jackson City, Mississippi. In total, the pharmacy submitted false claims in the amounts of 22,068,144 U.S. dollars to Tricare and other health care insurance programs. In committing the conspiracy, Moran and his co-conspirators, changed the prescription formulas to ensure they got the highest compensation, paid marketers and doctors illicit kickbacks to acquire prescriptions for high-yield compounded drugs regardless of their medical necessity, regularly reduced and/or forgone copayment collections, among other things.

Moran admitted guilty before Judge Starrett on 13th September 2018.

The case was investigated by the Federal Bureau of Investigation’s Jackson Field Office with assistance from the Internal Revenue Service Criminal Investigation, the Defense Criminal Investigative Services, and the Mississippi Bureau of Narcotics.
